Skilled workers with long – term job offers, can apply to enter or remain in the UK if they have a job offer here from a licensed sponsor with a valid certificate of sponsorship. They must also pass the points-based assessment. There are 4 categories of skilled worker under Tier 2 of the points-based system:

  • General skilled workers
  • Sportspeople
  • Ministers of Religion
  • Intra-company transferred staff


under Tier 5 a temporary worker can apply to enter the UK for a short time if, in the majority of cases, they have a job offer from a licensed sponsor and pass the points-based assessment. There are 5 categories of temporary worker under Tier 5 of the points-based system available for sponsorship (note the youth mobility scheme is not an employment route):

  • Creative and sporting
  • Charity workers
  • Religious workers
  • Government authorised exchange
  • International agreement

You can apply for a licence covering either tier or both.

Education providers

You can sponsor a foreign student to undertake a long course of study by obtaining a sponsor licence. The student must apply under Tier 4 of the points-based system. You do not need to sponsor a student on a short course of study as they can come to the UK as a student or child visitor (if under 18).

Sponsor Licence Requirements

  • They are a genuine organisation
  • Must be operating lawfully in the UK.
  • You must not have unspent criminal convictions for immigration offences or certain other crimes.
  • You must nominate staff members to fulfil the immigration-related roles in your organisation: an Authorising Officer, a Key Contact and a Level 1 User. These roles can be filled by the same person or different people.
  • You must be able to meet your responsibilities as a sponsor, which is judged by ensuring that you have effective HR systems.
  • You must supply the Home Office will all documents requested.
  • Meet any other requirements for the specific immigration tier under which your prospective employee is working.

Once a company holds a licence, it is then able to issue certificates of sponsorship to new employees, the certificate of sponsorship is required as part of each non-EEA individuals immigration application under tier 2 or 5.

Please note that successfully receiving a sponsorship licence and being placed on the register of sponsors does not guarantee that the employees you choose will be given permission to enter or stay in the UK. Employees must meet the requirements for their visa and entry clearance, and remain compliant with the conditions of their stay.
